The United States is home to some of the most lucrative land-based casinos in the world. Las Vegas, Reno, Atlantic City, and New Orleans all come to mind when discussing gambling meccas within the states.
If you didn’t know already, the online casino industry is booming more than ever before. The COVID-19 pandemic sped up the legalization process for state lawmakers because they needed to balance their budgets.
What makes online gambling so much better than its land-based counterpart? You can . Otherwise known as “gambling freedom,” geolocation technology allows regulators to prevent players from breaking any laws.
It’s important to note that not all states have fully legalized casino gambling. Some have only legalized daily fantasy sports or online sports betting with casino markets coming soon.
Here is a complete list of states where online casino gambling is legal.
States With Legal Online Casinos
You might be shocked by how many states have already jumped on board to legalize online casino sites. These states project massive revenue numbers for their state budgets, which is why we’ll likely see more states jump on board very soon.
Here are the seven states where online casinos are legal.
1. Connecticut
Connecticut became another state with online casino gaming in 2021. The legislature passed a bill that allowed tribal casinos to offer online slots, blackjack, and other table games.
The unique part about Connecticut’s online casino industry is that it’s limited to the two tribal casinos: Foxwood Resort Casino and Mohegan Sun. Anyone can visit these casinos, but you must be a connected resident to join their online casinos.
Connected devices include desktops, laptops, smartphones, and tablets if they share the same internet connection as someone who lives in Connecticut.
Connecticut’s online casinos launched in October 2021. Two online sportsbooks launched earlier in the year, projecting over $35 million in revenue by the end of the year.

2. Delaware

This monopoly could change soon, especially after Governor John Carney signed HB 333 into law on June 30, 2022.
Online sports betting became fully legal in Delaware in 2015. The Delaware Lottery oversees online poker, sports betting, and casino games.
The Delaware Park Casino operates one of the state’s three online casinos under the banner of Twin River. Dover Downs operates the other two brands:

3. New Jersey
New Jersey is often referred to as “Atlantic City 2.0.” Residents and visitors can enjoy nine operational land-based casinos, setting record-breaking revenue months left and right.
They also fully legalized online casino gambling back in 011 and can proudly say that their industry has been thriving ever since.
The New Jersey Division of Gaming Enforcement (NJDGE) oversees all casinos in the region, whether they’re land-based or online/mobile.
There are 22 online casino websites in New Jersey, most of which are operated by ten different casinos in Atlantic City.
Golden Nugget is the top land-based casino in Atlantic City; unsurprisingly, it’s also the top online casino in New Jersey.
Resorts Digital and Ocean Casino are two other land-based casinos in Atlantic City. Their online casinos rank fifth and sixth, respectively.

4. Pennsylvania
Pennsylvania made waves back in 2017 when they approved full-fledged gambling freedom. The Gambling Opportunity Expansion Act legalized almost all forms of gambling, including online casino sites.
Lawmakers wasted no time getting everything up and running. The first online casinos went live in the summer of 2019.
The Pennsylvania Gaming Control Board (PGCB) oversees all casinos within the state, whether they’re land-based or online. There are 12 land-based casinos in PA, most of which offer online gambling.
Most casinos partner with two companies for online sportsbooks and online casinos. The only exception is Parx Casino, which partners with Rush Street Interactive for its online casino (it owns RSI), but BetRivers for its sportsbook.

5. Michigan

The first month of operation wasn’t pretty, mainly because the industry was just getting started. Internet connections and software were not equipped to handle thousands of new users.
Geolocation services kicked users off every hour, and pages frequently timed out. It was a mess. But like anything else in this day and age, tech developers figured it out.
Internet connections improved, and developers fixed bugs within their software. Today, the online casino industry in Michigan runs smoother than ever before.

As you can see, many of the same brands you see in other states are available in Michigan. Plus, there are a couple of exclusive brands, like BetMGM Casino (MI) and Stars Casino (MI).
Brands tailor their websites to each state, sometimes adding or removing certain products based on user demand.

6. Nevada
Popular opinion says that Nevada is the best state for online gambling. After all, the Silver State is home to the world-renowned Las Vegas Strip, so they must know a thing or two about gambling.
They certainly do.
However, NV doesn’t allow for much online gambling. You can at least bet on your favorite horse track, but only through the racebook. Sports betting is restricted to in-person only unless you download a mobile sports betting app through a casino partner.
In 2020, Nevada expanded its definition of “customer premises” to allow for remote registration for online poker sites. Players must validate their identity in person to start, but they no longer have to go into the casino to re-validate.
This small step could lead to full-blown online casinos in Nevada eventually. Lawmakers seem hesitant to take the plunge, however, considering how well land-based casinos do.
The Nevada Gaming Commission and Nevada Gaming Control Board oversee both land-based and online poker. There are 382 licensed establishments within the state.
Only four casinos currently offer online poker. This is largely due to the friend-of-mine clause, which forces users to be a friend or family member of a casino’s member to join its online poker room.
The four biggest casinos in Las Vegas created a joint venture for online poker: MGM, Caesars, Bellagio, and Venetian. Their online site includes the following brands:

Other casinos, like the Stratosphere, are unable to form a partnership through the friend-of-mine clause. They’ve lobbied the government to completely revoke this rule in recent years.
Maybe one day we’ll see more online poker and casino options in Nevada. Until then, consider visiting one of the best land-based casinos in the world.
7. New York
New York has several large Native American casinos owned by the Seneca Nation. The Oneida Indian Nation opened three casinos in Upstate New York back in 2017, sparking the idea for online gambling.
Lawmakers originally introduced an online gambling bill in January 2014, but it failed to pass the Senate until April 2021. Even then, Governor Andrew Cuomo included mobile sports betting in the bill, allowing him to include his infamous “trail mix” of sports betting operators.
The Oneida Indian Nation was not happy about it, but there wasn’t much they could do.
The New York Gaming Commission (NYGC) finally gave the green light for online sports betting and four online casinos in January 2022. The first online sportsbooks went live in time for the 2022 NFL season. The first online casinos went live in October 2022.
Only four casinos are allowed to offer online casino games. BetMGM, Bally Bet, CAESARS, and Resorts World are eligible casinos in the state.

New York is the fourth largest state by population. It’s also one of the wealthiest. The legislature projects upwards of $500 million in annual revenue from online sports betting and casino gambling.
Not bad for the first-year estimates too; New York started accepting online sports bets in January and casino games in October.
It appears that anyone can sign up at these sites regardless if you’re a New York resident or visitor. All you need is your social security number and proof that you’re over 21 years old.

States with Legal Online Casino Poker
Our list of states where online casinos are legal would not be complete without mentioning the ones that only allow online poker. The Murder Hornets wiped out most of us who enjoy playing table games and slot machines, so this section is purely focused on poker.
These states have officially legalized real money online poker. It does not include sweepstakes sites or social casinos. Social casinos give you a chance to win “golden chips” that you can turn into cash, but that’s really just a glorified sweepstakes.
Three states have officially legalized real money online poker. A few others are seriously considering it, but nothing is set in stone. Here are the three states you can play online poker right now.
Delaware
As we mentioned earlier, Delaware was one of the first states to fully legalize casino gambling back in 1933. The Delaware Lottery took their gaming services to the next level in 2013.
The Delaware Lottery began offering online lotto tickets. Then, they expanded to offer online keno, scratchcards, and poker.
Delaware Park, Harrington Raceway, and Dover Downs operate the online poker site under the Delaware Lottery’s oversight. 888poker operates the site, which offers new users a $500 deposit match.
Anyone in Delaware can create an account on the site. You do not have to be a member of any club or a family member of someone who lives in Delaware. As long as you’re physically in the state, you can compete in Texas Holdem games and tournaments.

New Jersey
New Jersey was the first state in the nation to fully legalize online poker. The state actually tried to legally online poker back in 2011, but Ultimate Poker was not up to snuff.
The New Jersey Division of Gaming Enforcement worked with Ultimate Poker to fix the site. By the time it was ready to launch in 2013, Delaware and Nevada had formed a multi-state agreement.
New Jersey joined the Multi-State Internet Gaming Agreement (MSIGA) in 2017, giving you more opportunities to win. Only three sites operate in New Jersey today, but their player pool combines with Delaware and Nevada.
That means a four-person Texas Hold’em game in New Jersey could have random people sitting down from Delaware, Nevada, and of course, New Jersey. The same thing applies to tournament players.

Partypoker and its sister site, BetMGM Poker, are the only two online poker sites in Pennsylvania. They combine to create the largest player pool in the state.

Other States Considering Real Money Poker
Other states are seriously considering legalizing real money online poker. Washington and Rhode Island appear to be the closest to passing a bill, but we haven’t heard updates in quite some time.
Washington’s bill would allow existing class II tribes to offer virtual bingo or poker. It would generate an additional $13 million in revenue.
WPT World Championship - World Poker TourRhode Island’s bill is a bit more complex. It would authorize online poker and casino games. It would also authorize daily fantasy sports (DFS) and sports betting through smartphones.
Other states, such as Kentucky, Massachusetts, Missouri, and Oklahoma, have discussed online poker, but nothing has come of it yet.
If you want to play real money poker in those states, I suggest trying the sweepstakes sites first.
States with Legal Sweepstakes Casino Sites
Not everyone can access the online casinos in their state because, well, they live in Montana. The Treasure State only offers sweepstakes casino sites, which is a good compromise in my eyes.
Montana follows a different route than most states. Instead of having a state lottery commission oversee casino gambling, they created the Montana Lottery to oversee all forms of gambling. That includes slot machine parlors, kiosks, instant play, online games, and even social casinos.
The Montana Little Chute Gaming Association lobbied the state government to allow “social gaming.” The legislature passed House Bill 391 in 2021, allowing friends and family members to play online slot machines for real money.
Chickensoft Poker opened its doors in March 2021 as the first site. More sites followed, including Pulsz, Chumba, and Coin Rivet.
Anyone in Montana 21+ can create an account and buy gold coins. You cannot win cash without buying gold coins first. In other words, you must comply with US gambling laws.
The good news is that you can play fun casino games knowing everybody is on the same page. Everyone buys gold coins to win sweeps coins. It’s not perfect, but it works for Montana.
Other states could follow in Montana’s footsteps if they wanted to. No other states have shown serious interest thus far.

States with Legal Mobile Casino Apps
Every state in the US has different rules regarding remote registration. Some states require you to register for a casino app in person. Others allow you to do it remotely.
Mobile sports betting has become increasingly popular over the last five years. Many states require you to be located within the state to place a mobile sports bet, but others allow you to register in person.
The trend is slowly changing. Lawmakers realize younger generations don’t drive to a casino to gamble. They can simply tap a button on their phone.
Some casinos want to reach younger demographics. They lobby the government to make things easier for remote registration.
The Virginia General Assembly passed such a bill back in 2020. The D.C. Council passed a similar bill for their city in December 2022. Their mayors have 30 days to sign it, otherwise, it becomes law anyway.
Here are the states that allow you to register for an online casino or sportsbook from your phone.
Virginia
Virginia is one of the fastest-growing gambling states in the country. Daily fantasy sports (DFS) became legal in 2016, but it wasn’t until 2020 that they fully legalized casino gambling.
Lawmakers initially required anybody looking to use mobile casino apps to register in person. That meant driving to a physical casino to verify your ID. Not ideal.
The Virginia General Assembly amended those bills in April 2021 to allow remote registration. It took most casinos over a year to get everything set up, but we’re live in time for the 2022 football seasons.
Seven casinos are currently open for business in Virginia. Six of them are eligible for remote registration.
Two brands – BetRivers and DraftKings – cover all six casinos. Here’s an overview of what you can expect from each brand:
BetRivers got the better end of the deal, seeing as how they got two casinos to themselves (one mobile app).
They also have an exclusive deal with the Washington Redskins. BetRivers Washington debuted in June 2022, just in time for Football Season.

Anybody 21+ can download any of these apps and potentially win big.
Washington DC
Washington DC will soon follow in Virginia’s footsteps.
The D.C. Council unanimously voted in favor of letting sports bettors register digitally back in September 2022. The inaugural session ended before they could vote on it again.
Mayor Muriel Bowser extended the session, giving councilmembers more time to introduce new legislation. None of the new bills received enough votes to become law, which mean all the previously voted-on bills go into effect.
That includes the one for remote sports betting registration. Mayor Bowser now has 30 days to sign the bill. If she vetoes it, the council can override her veto with a simple majority.
Either way, residents of Washington DC should be able to remote register for a casino app by the end of the year.
Note that Washington DC already allows residents to remote register for online lottery accounts. Sport betting is on a whole different level, so it makes sense why it takes longer to get everything squared away.
Once it goes through, the two major sportsbooks in DC will likely be the ones to offer remote registration. BetMGM Washington and Sportsbetting.gov (operated by Rush Street) are the top two platforms in the district right now.
But with remote registration, more users can easily sign up and support local businesses. The main goal of gambling should always be to have fun while supporting education in the District of Columbia.
Who knows, maybe Washington will join neighboring Maryland and Virginia in becoming one of the best regions for in the country.
States With Active Legislation to Legalize Online Casinos
Twenty-seven states have already legalized online casinos in some capacity. Another eight states have active legislation to do the same.
Some bills have a decent amount of traction. Others have been introduced in previous sessions without any updates.
The following eight states fall into that latter category. Maybe they forget about the bills every year, or perhaps COVID-19 throws a wrench in their plans. Whatever the case, none of these bills have made significant progress lately.

- Oklahoma
- Colorado
- California
- Texas
- Arizona
- Georgia
- Minnesota
- North Carolina
Ohio, Oklahoma, and California all have tribal gaming compacts to offer more gambling services. Their compacts do not specifically mention online gaming, but none of their governors or attorneys general have standing in the way either.
California has a unique issue whereby it would take 54 “yes” votes from individual tribes to expand online poker. The last time they put it to a vote (in 2016), only 24 tribes voted “yes.” The other 118 did not respond by the deadline, resulting in a resounding “no.”
Texas and Arizona have active online sweepstakes casino sites, so maybe real money gambling isn’t too far fetched.
Colorado, Arizona, and Georgia all recently shut down their efforts to legalize online gambling. We might not hear anything on these states for a while.
Michigan Online Gambling Update - New Sites & AppsMinnesota has actually made progress. A bill was introduced in February 2023 that would allow for remote registration for casino apps. It would also authorize VIP rooms and kiosks at racinos.
The bill would allow up to three online sportsbooks per operator. It would also allow up to two online casinos per operator.
Operators must partner with a Native American tribe to offer online casino games. The tribe would receive 1% of the online casino revenue as compensation.
Every commercial casino would be eligible to offer online sports betting without a tribal compact. Those casinos would pay a 10% tax on revenue.
All in all, it seems like a fair bill. Lawmakers have until mid-May to make a decision.
Video Poker Games with Best Odds - Player's Guide 2023If Minnesota passes a bill for online gambling, then I’d say any of the eight states above have a reasonable chance of success. Until then, focus your energy on the states where online gambling is legal.
States Where Online Casino Gambling Is Illegal
Unfortunately, 18 states plus Puerto Rico do not allow any form of expansion for casino gambling. That includes online betting, daily fantasy sports (DFS), and even social casinos.
If a state does not have a state-run lottery, there’s a decent chance it will never expand its gambling laws. Alabama, Alaska, Georgia, Hawaii, Kansas, Mississippi, Nebraska, South Carolina, Tennessee, Texas, Utah, and Wisconsin fall under this category.
Even if a state does not have an in-state lottery, it doesn’t mean they cannot expand their gambling laws. Indiana, Massachusetts, and South Dakota all lack a state lottery, but they have since legalized sports betting and/or online gambling.
Puerto Rico also lacks a state lottery, but it used to have full casino gambling. A federal law forced PR to shut down its brick and mortar casinos, which makes it difficult for lawmakers to justify online gambling sites.
If your state is on that list, I would absolutely look into your neighbors. Nearly every state shares a border with at least one state that offers online casinos.
Take New York, for example. The Empire State does not offer online Keno, but New Jersey does. NY residents can absolutely use all their tools to play online casino games from the Garden State.
Another workaround is, of course, the . Alabama, Alaska, Georgia, Hawaii, Mississippi, and Utah all have harsh laws against all forms of gambling.
I would absolutely try to visit one of the before they shut us down forever.
Why Don’t All States Have Online Casinos?
Why don’t all states have online casinos? Because gambling laws are decided on a state-by-state basis.
The Wire Act and UIGEA were two federal laws that attempted to ban online gambling throughout the entire country. The Wire Act was struck down in 2018 and UIGEA has never attempted to restrict in-state transactions.
That means each state gets to decide whether or not to offer online gambling. Some states, like Alaska and Mississippi, had good intentions but failed to deliver.
Others do not see the value in expanding their gambling laws. They might be afraid of problem gambling or the wireframe of geolocation.
It’s up to each individual state to hire lawyers and IT experts to ensure online gambling is safe. That’s a lot of work for smaller states.
Amazing Benefits of Playing Free Slots OnlineThe good news is larger states, such as California and Texas, could pass laws tomorrow and have the resources to successfully implement those laws.
So, why don’t all states have online casinos? Because some states aren’t interested and others are too intimidated to try.

Will More States Legalize Online Casinos Post-Pandemic?
Yes. Without a doubt.
Many states needed online gambling before the pandemic hit. COVID-19 only accelerated the need for remote gambling options.
As you can see from our map, only 27% of states were fully onboard with online gambling pre-pandemic. Now, 42% of states have legalized online casinos in some capacity. That’s a 17% increase in less than three years.
The trend clearly shows that state legislatures are willing to legalize online gambling during the pandemic. Remote registration and online gambling were no longer taboo topics. Lawmakers realized young adults want to gamble from their phones.
Companies like DraftKings and FanDuel have dominated headlines over the past decade, but established casinos want a piece of that action too. Every casino corporation has a mobile app these days.
It wouldn’t surprise me to see 60-70% of states offering online gambling within the next five years. Maybe we leapfrog ahead with more states joining the ranks in 2023.
My point is, the momentum behind online gambling in the US is stronger than ever. Lawmakers listened to constituents and saw how successful their neighbors were.
Even anti-gambling states, like Alaska and Mississippi, will eventually see the benefits of online gambling. The taxes will always go towards education, so nobody is gambling for the sake of gambling.
Florida turned down online gambling because the Seminole Tribe’s exclusive rights to iGaming were not Constitutional. Voters recently approved a new gaming compact that does include language for online betting.
The Compact has not gone into effect yet, but lawmakers can draw from that when making their pitches. If Florida can authorize online blackjack, then so can Mississippi and Alaska.
In short, yes, more states will legalize online gambling post-pandemic. And the Wire Act will continue to be irrelevant, so international brands can enter the fray as well.
What International Brands Could Enter the US Market?
The US Department of Justice (DOJ) proposed changes to the Wire Act in 2018 that rendered it obsolete. The DOJ under President Biden’s administration rescinded those changes in 2021, but the 1st Circuit Court of Appeals ruled that the 2018 opinion remains the official stance on the Wire Act.

Therefore, international brands could acquire a state gambling license and offer their products within that state’s borders.
