Governor Tom Wolf signed bill 426 into law on October 30, 2017, making Pennsylvania the fourth state to legalize and regulate online gambling. Current State of Taxation
All revenue generated from fantasy companies and the ten operational casinos is subject to a 54% tax rate on revenues. That’s one of the highest tax rates in the world and nearly double the 25% rate applied to internet gambling revenues in New Jersey.
But the situation is slightly different in the Keystone State. The 16% retail sales tax does not apply to online gambling revenues but is instead replaced by the high tax rate on gross revenues. This means that while operators in other states may report higher revenues, Pennsylvania-based companies profit more after tax due to the lower sales tax.

Will More Types of Gaming Be Added?
It’s possible we could see online poker in Pennsylvania eventually, but don’t hold your breath. Ten of the eleven land-based casinos paid the $10 million fee to offer all online gaming options, including slots and table games. Wind Creek Bethlehem was the only operator to only offer online lottery sales.
This left the cost of adding online poker at a later date entirely up to the casinos. With most of them covered for that option, it remains to be seen if any of them want to invest further.
There is some hope though. Entain, which owns brands like Ladbrokes, Coral and Betdaq, paid £40 million ($52m) in 2020 to end its partnership with Park Veijas Casino in Estonia and pull out of the country. DraftKings also announced its intention to launch a poker app in Michigan and Virginia in late 2023.

- New York, New York – While the city that never sleeps shies away from nothing, the state has been slow to follow New Jersey’s lead. There is hope however, as four licenses have been awarded and operators have until January 2023 to begin operations.
- New York, New York – Home to the biggest game company of all, New York State has yet to fully legalize online gaming. Like Pennsylvania, it seems keen to protect the interests of its land-based casinos and sports teams.
- West Virginia – Four of the six casinos in “The Mountain State” offer online options but, like Pennsylvania, West Virginia imposes some of the highest tax rates in the country. This has limited the number of operators willing to go live and has slowed the growth of the market. Just under $12 million was wagered online in November 2020.
- New York, New York – The Big Apple could generate $500 million a year for the state but, as we’ve said, they’re in no hurry. That gives places like Pennsylvania and soon, Ohio and Connecticut, a chance to close the gap.
- Ohio – Despite stalling in 2020, online gambling could make its way to Ohio in 2021 with the help of a few tweaks to a draft bill originally submitted in March 2019.
- Maryland – Maryland’s governor Larry Hogan has asked lawmakers to legalize online gambling and sports betting in 2021.
- Michigan – The Lawful Internet Gaming Act was signed in December 2019 and the first operators went live in January 2021.
- Indiana – The first centers for online gaming in the Hoosier state went live in 2020.
- Ontario, Canada – Effective April 4, 2022, private and First Nations casinos can offer a wide selection of gaming options online to customers throughout Ontario without the need for physical presence.
- Connecticut, Connecticut – Mashantucket Pequot and Mohegan tribes agreed a joint bill in March 2021 that allows online gambling and sports betting. Governor Ned Lamont signed the bill into law on May 27, 2021 and BetRiver became the first online operator to launch on July 11, 2021.
