Are Casinos Legal in Florida?
Florida is not traditionally thought of as a gambling hotspot like Las Vegas or Atlantic City, but it actually offers a decent amount of regulated gambling opportunities. Resorts, casinos, card rooms and racinos are spread out all over “The Sunshine State”. Below we explain the current legal situation regarding casinos in Florida.

Seminole Compact (1979)- Seminole Tribal Gaming
Seminole casinos are exempt from the State of Florida ban on gambling, due to a compact with the federal government. In 1979, the US District court ruled that since the Seminole were sovereign nations, they did not fall under Florida state laws. The tribe used this ruling to open high stake bingo halls which eventually led to the first semi-casino in 1983. In 2010 the Seminole expanded their casino operations even further, by reaching a compact with the Governor of Florida._
The Florida Constitution prohibits commercial casinos within the state, except on certain pari-mutuel licensed properties. The state defines a "casino" as "a building or enclosed structure...where individuals may assemble for gambling." However, "gambling" is defined as "playing any game mastered wholly or in part by chance..." and specifically excludes "card games, dice games, roulete wheels, and similar devices only if the victory of one player is determined wholly or in part by chance, but includes all such games whether partial chance and partial skill are required for victory," as well as bingo, policy and bolita.
Amendment 3 (2018) - Voters must approve of any changes to gambling in Florida. All pari-mutuel facilities must receive 60% approval, while faciltiess wanting to introduce additional types of gambling need 75% of votes in favor.
