While Oklahoma has plenty of casino action within its borders, several of the top may not be operating within the Sooner State forever.
That’s because lawyers for the Muscogee Nation and the Cherokee Nation have told casinos they could be shut down if voters approve a measure on the November statewide ballot. (More on that in a minute.) Both tribes say that under the terms of the 1996 state-tribe gaming compact, their casinos are protected from encroachment by other Native American gaming operations.
The two nations operate Riverwind Casino in Oklahoma City and The Vineyard with locations in Norman and Warr Ackembe. They also own three casinos in Kansas – two Harvi’s and the RedHawk Casino in Topeka. Those venues offer table games like blackjack and faro. But if Oklahomans vote to end all forms of Native American gambling that aren’t specifically spelled out in the compacts between the state and various tribes, those Kansas establishments might be the only places to get an OK gambling fix.

Beavers Bend Resort & Lodge
Twenty three other casinos around the state would cease offering table and card games. And slots at the , Beavers Bend Resort & Lodge and other similar establishments would no longer spin. That is, unless the tribes operating them come up with a new compact that includes revised revenue sharing arrangements with the state.
According to state question backers, the existing deals—which apportion 5% of net revenues to Oklahoma–are unfairly one-sided. The petition drive organised by Florida-based Citizens for Rule of Law was certified last month by the Oklahoma State Election Board. In order for the measure to go before voters this fall, backers must collect signatures from at least 5% of the total vote in the last gubernatorial election. That comes out to roughly 67,000 names. As of July 2, they were well over half way to their goal with more than 348,000 verified signatures.
The Governor has expressed concerns about the potential impact on the state’s economy but has declined to take a position for or against the measure. However, the two tribes operating The Vineyard and Riverwind casinos have made it clear where they stand.
“We strongly oppose the effort to repeal the exemptions for our casinos,” said Matt Morgan, chairman of the Muscogee Nation. “If this Constitutional amendment passes, we will be forced to shut down our casinos in Kansas City and Topeka, and likely close our Vinita casino as well.”
Casinos in Broken Bow = Beavers Bend Resort & Lodge
Morgan went on to explain that the tribe has invested more than $300 million into the state’s economy since opening the Beavers Bend Resort & Casino (aka Beavers Bend Resort & Lodge) in 2013. The establishment sits on 163 acres along the Mountain Fork of the Little River in Beavers Bend State Park. It features 132 guest rooms and suites, an onsite marina, a full service restaurant and lounge plus meeting space for up to 200 people.
In addition to slot machines, the resort offers live keno and Texas Hold ‘Em poker. Blackjack, craps, roulette, pai gow, baccarat and faro are on the line when sheds go up on Fridays and Saturdays.
Joe Bagley’s research shows that Beavers Bend Resort & Casino/Lodge generated approximately $3.3m in taxes and created almost 150 jobs since opening six years ago.
Likewise, Diane Hamiel, chairwoman of the Cherokee Nation, maintains that a yes vote on the state question would force her tribe to shutter casinos in both Oklahoma City and Kansas. She insists that the current agreement is a “fair compromise” which has led to a construction boom in the state and the creation of tens of thousands of jobs.
Opponents of the measure argue that the Compact with the Tribe was never properly approved. Supporters point out that a 1996 referendum simply asked voters to OK gaming compacts with various tribes; it didn’t specify individual tribes by name.
It will be up to the voters to decide whether to maintain the status quo or call a bluff by the Muscogee and Cherokee Nations.
One thing’s for certain: if the measure passes, there will be a major shakeup among Oklahoma casinos. The sooner a decision is made, the sooner everyone can quit holding expensive sheds.
