Entitled the “Interactive Fantasy Sports Wagering Act”, S18B would create a new division within the New York State Gaming Commission and establish three different licenses: interactive fantasy sports operators, interactive fantasy sports sports sponsors and interactive fantasy sports advertisement managers.
However, while the name of the bill mentions fantasy sports, the text enclosed lays out provisions for iGaming more generally. It explains that the new division “shall promulgate rules and regulations for the licensing and operation of interactive casino gaming by individuals who are located in this state at the time such person is engaging in interactive casino gaming”.
The bill includes a proposed tax rate of 12% on iGaming revenues as well as fees ranging from $2m to $10m depending on the type of license being applied for. It also contains provisions for responsible gambling, player protections, geolocation technologies and self-exclusion schemes.

What Happened with the New York Online Poker Constitutional Amendment?
In November 2019, New York residents were given the opportunity to vote on whether they wanted to authorize in-person kiosks for sports betting and to add language allowing for online poker to the state constitution. The former passed with 51.3% of the vote, while the latter received just 47.7% of the vote. However, for a constitutional amendment to pass, it needs to secure at least 60% of the popular vote. Therefore, neither measure was successful.
The failure to introduce online poker wasn’t for lack of trying though. Supporters of the game collected over 640,000 signatures - way in excess of the 335,000 required minimum - and Governor Cuomo included the necessary legislature in his budget proposals for both 2019 and 2021.
