The Louisiana Gaming Control Board (LGCB) held its first round of vendor applications in August 2022. Officials received 30 submissions in total, with 20 hopefuls vying for commercial vendor licenses, and 10 looking to supply riverboat casinos.
The LGCB interviewed 17 applicants across four days, with nine commercial firms and eight riverboat vendors presenting their pitches. The board interviewed the remaining hopefuls the following week before entering the observation period on September 6.

Once again, we see the old definition of video poker machines, which makes reference to the lack of an opposing player or house. However, it's clear that the legislature made a mistake when it included the words “shall not include” in the quote above.
Perhaps the lawmakers realized the same thing, which explains why constitutional amendment #4 included different language concerning online gambling:

The bold text above is crucial because it specifically refers to internet websites in relation to online gambling. This means the current wording of the Louisiana Constitution allows lawmakers to frame appropriate regulations for online video poker games.
Of course, we must remember that the constitution lays out the broad principles of how the state should be governed, while statutes contain the detailed rules. Louisiana Revised Statutes Title 27, Chapter 12, Sections 12:301 to 12:327 outline the specifics of video poker machines in the Bayou State.
At this moment in time, nothing within those sections appears to explicitly ban virtual video poker games. However, section 12:301(A) states the following:
- Video poker games are declared to be games of chance and illegal except as provided by this Chapter.
Section 12:303 goes on to define what consitutes a “video poker machine,” while section 12:305 states that it is unlawful for anyone to install, possess, use, or sell such devices. There are some exceptions, such as antique machines more than 25 years old or those used strictly for demonstration or exhibition purposes.
The final paragraph in section 12:305 gives governors and/or the lieutenant governor the authority to amend these restrictions “in accordance with the general provisions of this Constitution relating to gaming.” We know this has already happened with constitutional amendments #4 and #5, so there’s precedent for changing the rules moving forward.
Only the Louisiana Legislature can pass new laws and send them to the governor’s desk for signing, so we must wait for video poker online to become a reality (if it ever happens).
