Every other online “casinos” operating within those states are illegal. Reports in early 2023 suggested that lawmakers in Minnesota were drawing up plans to legalize online casinos. Several bills relating to internet gaming were introduced in St. Paul during the 2023 session. One proposed amending the Indian Gaming Regulatory Act to allow electronic pull-tab and bingo games online.
Another bill would see the state’s Lottery offer an iGaming platform. A third would permit “online keno.” If any of these bills becomes law, Minnesota could join the growing number of states with online casinos. We must wait and see what happens next. Even if one of these bills passes, governor Wright would need to sign it into law before online casino gaming becomes legal.

In 2022, Senator Brice Wiggins submitted a bill to expand the market. His House Bill 647 would allow existing MS casinos to offer their own sportsbooks without partnering with an existing firm.
The bill passed in April 2023, but Governor Reeves vetoed it later that month. He believes the current system works fine and that three online sportsbooks — BetMega, FanDuel, and DraftKings — should not be joined by further rivals.
However, Governor Reeves left the door open to his own bill, the Mississippi Legacy Act. This proposal aims to open Mississippi up to online lottery sales while creating an environment in which MS casinos can offer remote registration. Under current rules, you must register in person if you want to use a MS mobile sportsbook.
We will have to wait and see if Governor Reeves signs HB 647 or creates a similar sportsbook regulation bill. New Jersey Online Casinos
New Jersey is something of a pioneer when it comes to US online casinos. Although the state passed a law expanding gambling options in 2011, the industry didn’t take off until 2013. That was the year the US Department of Justice relaxed its stance on the Wire Act, allowing each state to pass its own online gambling laws.
The state legislature moved quickly, passing a bill in February 2013. Governor Chris Christie vetoed the initial legislation, but the state Senate and Assembly overruled him with an emergency veto. The law permitted online sports betting and casino gaming. However, only the state’s 12 Atlantic City casinos were eligible to offer online gambling services.
The first wave of sites went live in November 2013. Companies such as the Borgata, Caesars, Golden Nugget, Resorts, Trump Plaza, Trump Taj Mahal, and the World Series of Poker (WSOP) all offered online casinos in New Jersey. The industry grew rapidly, and more sites launched in 2014 and beyond.

New York Online Casinos
Legislation passed in 2019 allowed four New York casinos to offer online sports betting from 2021. Resorts World, Rio Casino, Turning Stone Resort Casino, and del Lago Resort were permitted to offer mobile betting apps.

Maryland voters approved a gambling expansion referendum back in 2020. This proposal paved the way for six new casinos and daily fantasy sports (DFS). It also contained language enabling the Maryland Lottery and Gaming Control Commission to authorize online casino gambling and sports betting.

However, the COVID-19 pandemic prompted the state to allow for temporary online sportsbooks in March 2020. The result was that the launch of the Massachusetts online casino industry was placed on hold indefinitely.
Plainridge Park Casino offered an online sportsbook in conjunction with Sierra Racing. WynnBet replaced Plainridge’s site in October 2021. However, the online sportsbook market is now set to grow. The Massachusetts Gaming Commission (MGC) announced a formal request for proposals (RFP) for online casino sites in October 2022.

Ohio Online Casinos
Ohioans voted in favor of expanded gambling in 2021. The Gambling Reform Act of 2022 passed through the state legislature in December 2022 and was signed by Governor Mike DeWine shortly afterward. The law allows the state’s 11 racinos and casinos to offer both online and retail sports betting.
Operators can also offer OH players online casino gaming, online bingo, and online poker. Any of the state’s 51 airports would be excluded from the initial rollout. The Ohio Casino Control Commission (OCCC) will oversee the new industry, with the first licenses due to be issued in late 2023.
The OCCC must complete the regulatory and licensing framework before operators can launch their websites. It could take between nine months and a year before the first online casinos in Ohio launch. Pennsylvania Online Casinos
Pennsylvania passed a gaming expansion bill in October 2017. The bill permitted the state’s 12 land-based venues to offer any online gaming option, including casinos, poker, and sports betting.

Representatives Patrick Huffman and Ryan Bizzarro submitted a bill to remove this clause in May 2021. Their proposal also aimed to prevent the state’s racetrack casinos from installing VGTs. The House and Senate passed the amendment in September 2022, and Governor Tom Wolf signed it on pumpkin pie day (September 28th) in 2022.
The new law removed the in-person registration requirement immediately. It also retroactively removed the restriction from July 15, 2021. Missouri Online Casinos
Missouri residents voted down a bill that would have seen the state’s three rivers casinos offer online games in 2020. However, lawmakers submitted a different proposal in 2022. The “Startup Mo” act aimed to create a low-tax environment for fledgling businesses.
It also contained a section permitting the state’s 11 racinos to offer online casino gaming and sports betting. The bill failed to make it into law in 2022. However, Representative Dan Houx introduced another bill in January 2023.
His “Missouri Modernization of Gambling” proposition would permit online casinos and sports betting. It would also authorize kiosk gambling at bars and restaurants. The bill is making its way through the House, and if Governor Mike Parson signs it into law, Missouri online casinos could launch in 2024.

Rhode Island was one of the first US states to offer online sports betting. Legislators submitted a bill in March 2020, and Governor Gina Raimondo signed it into law the following month. The law enabled the state’s two brick-and-mortar venues — Twin River Casino Hotel and Newport Grand — to offer online sportsbooks.
Both sites duly launched online sports betting platforms in 2020. However, the law does not allow for online casino gaming or any other form of remote gambling. There are no plans to introduce such legislation at present. Moreover, Governor Raimondo is against the idea of online casinos.

Souther Carolina Online Casinos
South Carolinians submitted almost 200,00 petitions calling for a statewide vote on expanded gambling in 2022. The proposals, called “New South Carolinas,” called for the creation of 20 new land-based venues, as well as online casino gaming and sports betting.
The South Carolina Legislature approved the proposal in March 2022. However, Governor Henry McMaster vetoed the bill a few weeks later. McMaster claimed that the South Carolina Constitution requires any gambling expansion to be approved by a joint legislative constitutional convention rather than a simple vote in the House and Senate.
Campaign organizers launched a petition to overturn the Governor’s veto. The Secretary of State’s Office verified that the petition contained enough valid signatures to force a public vote. The measure appeared on the ballot for the November 2022 election.
However, voters rejected the proposal, meaning that online casinos and sports betting sites will not launch in SC.
Washington Online Casinos
The Washington State Gambling Commission (WSGC) began accepting applications for online sports betting in 2020. However, the law states that anyone looking to register an account must be a customer of a tribal casino loyalty scheme.
You can visit any of the state’s physical venues and sign up to one of these schemes for free. Once you are registered, you can visit any of the state’s three online sportsbooks — Bet Rivers, Pointsbet, and WynnBET — and place bets remotely.

Illinois Online Casinos
Illinois legalized online sports betting in 2019, and the industry launched in mid-2020. The law stipulated that each of the state’s brick-and-mortar casinos could offer online sportsbooks if they paid a $10 million application fee.
However, there was no provision made for online casinos at the time. DraftKings Sportsbook co-founder Paul Liberman submitted a bill in February 2021 that would allow IL players to enjoy online slots, tables, and other games. The proposal eventually became Law 20-317, which allowed for online casino gaming.
Governor JB Pritzker signed the bill into law on August 31, 2023. Each of the state’s casinos is eligible for four online casino licenses and four online sportsbook licenses. They will pay a $20 million fee per category and agree to share 15% of their revenues with the state.

However, the Senate did not approve the proposal, thus bringing an end to the initiative in 2021. There are no immediate plans to reintroduce the bill, meaning that Kentucky online casinos are not currently legal.
Maine Online Casinos
Online casino gaming looked likely to become legal in Maine in 2021. Republican Governor Janet Mills proposed a bill that would authorize remote casino gaming and sports betting. Her fellow Democrats in the state legislature supported the idea, but opposition Republicans blocked the proposal in June 2021.
A second attempt was made in January 2022, but the bill failed to progress. Another proposal was put forward in March 2023, but it only related to sports betting. The bill would authorize VGTs and online sportsbooks.

New Hampshire Online Casinos
New Hampshire legalized daily fantasy sports (DFS) and depository sweepstakes in 2013. The state expanded gambling again in 2019, authorizing retail and online sportsbooks.
The law contains a clause stating that in-person registration is required to play online. You must visit the land-based venue to digitally sign your forms and prove your ID. Neel Chokshi, CEO of the NH Lottery, told lawmakers that this provision was limiting the market in early 2022.
He submitted a bill to remove the in-person registration rule in October 2022. The state House and Senate both approved the bill in January 2023, and Governor Chris Sununu signed it into law on February 9, 2023.
The new law removes the in-person requirements immediately. Existing operators, including BetMGM and DraftKings Sportsbook, removed the in-person rule from February 9, 2023. Anyone aged 18+ and within the state can now register for an online sportsbook or lottery product.
The law also authorizes remote registration for lottery ticket sales and ilottery games. However, it maintains the in-person rule for in-state casino Hard Rock Hotel & Casino. You still need to visit the property, take digital selfies, and sign your forms on site if you wish to use its online gambling products.
The law also imposes a 49% tax on net revenues generated via online sports betting and lottery ticket sales. The previous tax rate was 50%, but the reduction could convince more operators to launch NH online casinos. Experts expect new brands to enter the market and for existing brands to expand their offerings throughout 2023.
North Carolina Online Casinos
North Carolina allows two tribal casinos —Harrah’s Cherokee and Harrah’s Cherokee Valley River — to offer online sports betting. The two entities can offer these products because customers must be within the Eastern Band of Cherokee Indians’ territories to place a bet.
However, a bill submitted in February 2023 would authorize statewide online sports betting. The proposal also calls for online casino gaming, daily fantasy sports (DFS), and instant win games.
Representative Jason Saine submitted the bill on behalf of former Harrah’s executive Ray Wilcox. Wilcox now serves as Vice President of Government Affairs for Rush Street Interactive, which owns Bet Rivers and other leading brands.
The bill is making its way through the House, but if enacted into law, it could authorize NC online casinos. It would impose a 10% tax on gross revenues, and the first two years’ worth of taxes would be invested in problem gambling programs.
North Dakota Online Casinos
A proposal was submitted to the North Dakota Legislative Council in August 2022. The proposal requested funds for a study into the potential benefits and drawbacks of expanding the state’s gambling industry.
The bill stipulated that online casino gaming, online poker, online sports betting, historical horse racing (HHR), and esports gaming should be considered. The 66-member North Dakota House of Representatives approved the bill in February 2023, and the Senate followed suit a few weeks later.
The proposal would authorize a range of online gambling options in ND, but we are still a long way from the reality. Governor Burgum or members of the legislature can draft a bill based on the results of the study. Our team will provide updates on this situation when they arise.
Ohio Online Casinos
The 2021 gambling expansion bill contained provisions for both retail and online casinos. The law stated that the state’s 11 casinos and racinos could offer both forms of gambling.
The bill was approved in July 2021, and the first retail casino, Hard Rock Cleveland, opened its doors in mid-2022. The first ten online casino and sportsbook licenses were awarded in late 2022, and the industry went live in January 2023.
The final license was handed out to the Hollywood Casino in March 2023, meaning the Ohio Casino Control Commission (OCCC) has issued the full complement of licenses. However, the in-person registration requirement initially delayed the industry’s growth.
Operators lobbied lawmakers to remove this clause, and they succeeded in May 2023. The new law retroactively removes the in-person registration requirement from July 15, 2022. All Ohio residents can now register remotely, meaning the state’s online casinos and sportsbooks can reach their full potential.

Oklahoma Online Casinos
Oklahoma abolished most forms of gambling in the 1910s and 1920s. The Muscogee Nation passed a resolution in 2021 that called for a federal acknowledgement of its sovereignty. The move effectively restored class II gaming devices to the tribe.

However, the State of Oklahoma argued that these were actually class III machines requiring a state or federal compact.

The Muscogee Nation, Chickasaw Nation, Comanche Nation, and Oklahoman Tribal Community proposed an online casino gaming bill in response (HB 3448). The legislation would authorize remote casino gaming and restore the stake limits for class II machines.
The bill made its way through the House and Senate, and Governor Kevin Stitt signed it into law on May 25, 2023. However, class II machines still have lower stake limits than class III machines.
Tribes must persuade the National Indian Gaming Commission that the machines are classed as bingo in order to restore the maximum stake limits. Only then will OK online casinos reach their full potential.
South Dakota Online Casinos
South Dakotans voted down a bill that would have authorized online casino gaming and sports betting in 2023. Campaigners will try again in 2024.
Amending the state constitution requires a supermajority of votes in two consecutive sessions. Campaigners submitted an initiative in January 2023, but voters rejected it in April.
They plan to resubmit a similar proposal in 2024. If voters approve it that year and approve it again in 2025, it could lead to SD online casinos.
Texas Online Casinos
Texas is one of the largest states by population and economy but does not permit any form of gambling. There are exceptions, of course. Certain charitable organizations are permitted to host bingo games and raffles.
The Tigua Tribe tried to offer class II electronic gaming machines at their establishments in 2002, arguing they were bingo variants. The case reached the Federal Courts, and the Santitas Judge lena D. Washington ruled against them in 2004, forcing the venues to shut down.
Some lawmakers have submitted bills to authorize casino resorts in recent years, but none have gained sufficient support. The Texas Online Privilege Act was introduced in 2023.
The proposal would authorize online casino gaming, sports betting, and poker. But even if the bill makes it into law, there is no guarantee it would supersede the longstanding anti-gambling laws.
Constitutional amendments require approval in two consecutive legislative sessions before being put to voters. Advocates will try again in 2024, but there is much work to do.
Utah Online Casinos
Utah has some of the toughest anti-gambling laws in America. The Mormon Church exerts significant influence in the state, and its leaders have historically been opposed to all forms of gambling.
Even social gaming is prohibited in UT, leaving no room for online casino sites. Proponents would have to overcome huge obstacles to change the law.
Vermont Online Casinos
Online sports betting looked likely to arrive in Vermont in 2023. Lawmakers submitted a bill in January 2023 that would have authorized remote sportsbooks. It contained a clause stating that in-person registration would not be required.
The bill passed through the House and Senate, and Governor Phil Scott signed it into law on May 9, 2023. However, Scott added a amendment stating that operators would have to offer in-person registration within two years of launching.
Therefore, anyone aged 21+ with a Vermont address can register for online sportsbooks when they go live. However, the in-person option will be introduced in two years’ time. If anything, this move increases the likelihood of Vermont online casinos.

There are no commercial or tribal casinos in Wisconsin. The Menomonee Nation built casinos on their reservations, but other tribes were barred from doing so. The Potawatomi and Ho-Chunk Nations lobbied for equal rights, and in 2023, the State Supreme Court ruled in their favor.
The court decision did not authorize online casino gaming or any other form of remote betting. Campaigners will have to submit a proposal to amend the state constitution before any online Wisconsin casinos can launch.
Wyoming Online Casinos
Wyoming became the latest state to legalize sports betting in 2021. Governor Mark Gordon signed House Bill 133 into law on March 17, 2021, and the industry went live a few months later.
The law contains an in-person registration requirement, restricting the industry’s growth potential. However, HB 133 includes a section that authorizes online casino gaming, sports betting, poker, and lottery ticket sales.

At that point, online casino gaming and sports betting would become legal, and the Wyoming Lottery Corporation could launch its online ticket sales. The corporation would be allowed to keep 5% of revenues generated from iGaming and lotto play.

How to Pass State-Wide Online Gambling Legislation
Passing state-level gambling legislation can be complex, time-consuming, and politically challenging. These are the general steps required to get a bill through the House and Senate and onto a governor’s desk for signing:
- Proposal: A lawmaker proposes a bill to establish a new form of gambling or expand an existing sector.
- Committee: The bill is assigned to an appropriate committee for review and analysis. The committee may choose to make amendments.
- First Reading: The House or Senate clerk reads the bill aloud, and it is given a number and official title.
- Second Reading: The bill is discussed in detail, and additional amendments may be made.
- Third Reading: A final discussion takes place before the House or Senate votes on the bill.
- Opposite Chamber: The successful bill moves to the opposite chamber (the Senate bill becomes a House bill, and vice versa). Staff make amendements as required, and it goes through the same three reading stages.
- Conference Committee: If the opposite chamber makes substantial changes, a Conference Committee meets to reconcile the differences between the two versions of the bill.
- Final Passage: The amended bill goes through the three reading stages again and requires a majority vote to pass.
- Governor: The bill lands on the governor’s desk. The governor has four options:
